Acceptance of these terms

By using the Turfs Up Yard Visualizer you agree to these Terms of Use. If you do not agree, please do not use the tool. If you are using it on behalf of a company, homeowners association or property owner, you confirm you are authorised to do so.

What this tool is

The Visualizer is a design inspiration and enquiry tool. It produces an AI-generated concept image, an estimated area in square feet, suggested SYNLawn products and an indicative budget range. Everything it produces is preliminary, non-binding and for planning discussion only.

What this tool is not

• It is not a survey, site plan, construction drawing or engineering document.
• It is not a quotation, offer, warranty or contract.
• It does not confirm product availability, colours, lead times or installation dates.
• It does not assess drainage, grading, soil, utilities, permits, HOA rules or code compliance.

A Turfs Up site assessment is required before any binding quotation is issued.

Eligibility and accounts

You must be at least 18 years old to submit an enquiry. Staff accounts used for the admin dashboard are for authorised Turfs Up personnel only. You are responsible for keeping your credentials confidential and for all activity under your account.

Your content and the rights you grant us

You confirm that you own the photographs you upload or have permission to upload them, that they do not depict identifiable people without their consent, and that they do not infringe anyone's rights. You grant Turfs Up a non-exclusive, royalty-free licence to store, process and modify your images for the purpose of producing your visualization, servicing your enquiry and maintaining internal project records. We will not use your images in public marketing without asking you first.

Acceptable use

You agree not to:

• upload unlawful, obscene, hateful, or infringing images or content;
• upload photographs of property you have no connection to;
• attempt to reverse engineer, scrape, overload, probe or bypass the security of the service;
• use automated tools to submit enquiries, or submit false contact details;
• resell, white-label or otherwise commercially exploit outputs of the tool.

We may suspend access or remove content that breaches these terms.

Accuracy of estimates

Area figures derived from a photograph or aerial map depend on the quality of your photo, the reference measurement you provide and the accuracy of your outline. Real-world square footage frequently differs. Budget ranges are based on typical installations in the Carolinas and exclude site-specific work such as excavation, drainage correction, retaining structures, access difficulties, permits and disposal.

Intellectual property

Turfs Up names, logos, page content, product data and the software behind this tool are owned by Turfs Up or its licensors. SYNLawn and product names are trademarks of their respective owners. You may keep and use your generated concept images for your own project planning; all other rights are reserved.

Third-party services

The Visualizer relies on third-party hosting, mapping, storage and AI providers. Their availability is outside our control and we are not responsible for their acts or omissions.

Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error-free or that any output will meet your expectations.

Limitation of liability

To the fullest extent permitted by law, Turfs Up is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunity or wasted expenditure, arising from your use of the Visualizer or reliance on any visualization, measurement or estimate it produces. Our total liability for any claim relating to the Visualizer is limited to one hundred US dollars (US$100). Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to indemnify Turfs Up against claims, losses and reasonable legal costs arising from content you upload or from your breach of these terms.

Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in North Carolina, and you consent to that jurisdiction. We encourage you to contact us first at enquiry@turfsup.com so we can try to resolve the matter informally.

Changes

We may update these terms; the revision date above shows the current version. Continued use after a change means you accept the updated terms.
